Please provide your view on the following issue.
I have received a mail from MCA, which says that "in term of the provisions under Regulation 17 of the Companies Regulations, 1956, the form dated _________ filed by you _____________ vide SRN _______ has been examined and marked as Pending under Regulation 17(6) with the following remarks- " marked under Reg 17(6) since 150 days is over pl.."
The aforesaid form was earlier pending for action, after submitting the required clarifications.
Regulation 17 (6) says that "Registrar shall not keep any document pending for approval and registration or for taking on record or for rejection or otherwise for more than one hundred twenty days, from the date of its filing ........"
Now, please clarify as to, whether it is a notice of system for the necessary action from the concerned ROC or is it a notice to the company for approaching the ROC to get the form Registered.
The provision prescribed responsibility on Registrar. So, in this case, do the company has to wait until Registrar gives certain remarks against the form or to immediately approach ROC for necessary action.
